TRATAMIENTO DE DATOS PERSONALES EN LA NUBE
In accordance with Article 52 of the Regulations of the Federal Law on Protection of Personal Data Held by Private Parties, Farmacias Modernas de Tijuana, S.A. de C.V. establishes that the processing of personal data in services, applications, and infrastructure in the so-called cloud computing, which will be used through its software provider, is fully safeguarded under the terms and general clauses established in the signed contract. The clauses set forth in the service provision contract comply with the guidelines established in the referenced article in this section.
RETENTION PERIODS
Farmacias Modernas de Tijuana S.A. de C.V. will proceed to cancel and delete personal data after first blocking it once it has fulfilled the purpose that justified its processing. The cancellation of personal data will not be carried out when the provisions of Articles 26 and 34 of the Federal Law on Protection of Personal Data Held by Private Parties and Article 8 of its Regulations apply.
EXERCISE OF ARCO RIGHTS
We will gladly comply with any request we receive from the data subject or their legal representative to exercise their rights of Access, Rectification, Cancellation, or Opposition regarding their personal data held by Farmacias Modernas de Tijuana S.A. de C.V. We will receive your request through the means made available to you, as described in the “AVAILABLE MEANS OF COMMUNICATION” section at the top of this notice. The request, whether made directly at our offices or electronically, must include the following information:
- Name and address, as well as any additional information that can be used to contact you.
- Documents proving identity (Voter ID, Driver’s License, or document accrediting legal representation).

If the information provided in your request form is incorrect or insufficient, or if the corresponding accreditation documents are not attached, we may request that you provide the necessary elements or documents to process the request within five business days following receipt of the request. The data subject will have ten business days to respond to this requirement, counted from the day after it was received. If no response is given within this period, the request will be considered as not submitted.
Farmacias Modernas de Tijuana, S.A. de C.V., or its representatives, will respond to the data subject within a maximum period of twenty business days from the date the request was received so that, if applicable, the Responsible Party can act on it within the following fifteen business days from when the response is communicated.
In all cases, the response will be provided through the same channel by which the request was submitted or, if applicable, by any other means agreed upon with the data subject. The aforementioned timeframes may be extended in accordance with the Federal Law on Protection of Personal Data Held by Private Parties and its regulations.
DATA PROTECTION
The Responsible Party and/or its Officers will retain the data subject’s personal data for as long as necessary to process their requests for information, products, and/or services, as well as to maintain accounting, financial, and audit records in accordance with the Federal Law on Protection of Personal Data Held by Private Parties, current commercial, tax, and administrative legislation. They will also control the disclosure of such data or information of any kind. The collected personal data will be protected by appropriate administrative, technical, and physical security measures against damage, loss, alteration, destruction, or unauthorized use, access, or processing, in accordance with the provisions of the Law, its regulations, and other applicable legislation.
You or your duly accredited legal representative may limit the use or disclosure of your personal data through the same means and procedures provided for the exercise of ARCO Rights. Once your request is accepted, it will be registered in the exclusion list maintained by Farmacias Modernas de Tijuana, S.A. de C.V.
If you believe that Farmacias Modernas de Tijuana, S.A. de C.V. has violated your right to the protection of your personal data, you have the right to appeal to the National Institute for Transparency, Access to Information and Personal Data Protection (INAI).
REVOCATION OF CONSENT
According to Article 21 of the Regulations of the Federal Law on Protection of Personal Data Held by Private Parties, you may revoke at any time the consent you have given us for the processing of your personal data, so that we cease to use and transfer them through the mechanisms provided for this purpose in this document. Likewise, it is necessary that you send us your request through the means mentioned in this notice, specifically in the section on the exercise of ARCO rights, and it must be accompanied by the following information:

MEASURES TO SAFEGUARD INFORMATION PROVIDED TO THIRD PARTIES
Farmacias Modernas de Tijuana, S.A. de C.V. states that all personal data subject to transfer to the aforementioned third parties is properly safeguarded through agreements and contracts signed with those third parties (with the exception of the authorities mentioned), including confidentiality clauses that comply with the requirements established by the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations. ROMA CARD PROGRAM “MORE THAN A PHARMACY”
Customer participation in this Program implies acceptance of these terms and conditions.
The Roma Card “More Than a Wallet” is Farmacias Roma’s loyalty program.
It has permanent validity and is valid at all Farmacias Roma branches (except institutional sales branches).
This program is available to all Farmacias Roma customers who make purchases by presenting their Roma Card “More Than a Wallet.” To obtain a Program Card, simply visit any Farmacias Roma branch, and you will receive one completely free of charge.
ENROLLMENT
To enjoy all the benefits of the Program, you must provide the requested information in order to personalize your Card. This data will be stored in the system, allowing you to track your purchase history and promotions through your Roma Card “More Than a Wallet.”
To make your enrollment and card personalization easier, you can do so through our Customer Service Line by calling 800 025 ROMA, selecting the Roma Card “More Than a Wallet” option.
RULES FOR ACCUMULATION, REDEMPTION, AND BALANCE INQUIRIES
The Roma Card “More Than a Wallet” Loyalty Program is based on an electronic card where you can accumulate a variable percentage of the value of your purchases. This accumulation will hereafter be referred to as ROMAPESOS, meaning what you accumulate on your Roma Card will be ROMAPESOS, and their value upon redemption will be one-to-one.
1 ROMAPESO = 1 traditional peso.
The accumulation percentage per product and its validity period will vary. You can check this directly at the time of payment or by asking any staff member at your local Roma branch.
Products that are already on sale or part of another promotion may be excluded from participation in this program during that period.
Additional benefits will be added to the Roma Card “More Than a Wallet” Program, which you can review in the corresponding section on this same website.
There will be partnerships with other companies to offer you greater benefits (check the Business Partners section to see participants, benefits, and their validity).
To check your balance and purchase history within the Program, you can go to the “Check Your Balance” section on this website or call 800 025 ROMA.
If you only need a balance inquiry, you may request it at any Roma branch from any of our staff.
ACCUMULATION AND REDEMPTION RESTRICTIONS
They do not participate in the Program, neither for accumulation nor for redemption:
- Controlled medications.
- Alcoholic beverages.
- Tobacco.
- Phone cards.
- Electronic recharges.
- Ticket purchases.
- Service payments.
When we have special promotions in our INMÉDICA service, they will also be published in this section of the site (additional benefits and their validity will be posted).
RETURN POLICY
If you need to return a product that was purchased using the Program, meaning it earned some percentage on your Tarjeta Roma “Más que un Monedero,” it will be essential to:
- Present the purchase receipt.
- Present the Tarjeta Roma “Más que un Monedero” that was used at the time of purchase.
- No more than 30 days can pass to request the return.
- Your Tarjeta Roma “Más que un Monedero” must have a sufficient balance for the system to allow the return, as the balance granted as a benefit from purchasing the product being returned will be deducted from your Tarjeta Roma “Más que un Monedero.”
If the balance granted for the product being returned does not exist on your Tarjeta Roma “Más que un Monedero,” it will be deducted from the value of the product.
If, for any reason, the balance is insufficient, the return will not be allowed.
SPECIAL CONDITIONS OF YOUR TARJETA ROMA
(Lockouts, theft or loss, and balance transfers)
- If your Tarjeta Roma “Más que un Monedero” shows any BLOCKING at the time of making a payment, it is likely due to a security filter where the system detected unusual behavior and automatically blocked it. Please report this by calling 800 025 ROMA, where we will gladly assist you and provide a solution.
- If you lose your Tarjeta Roma “Más que un Monedero” or it gets stolen, please report it immediately to the Customer Service Line at 800 025 ROMA. If your balance has not been used, it will be protected from the moment of the report.
- If you need to transfer your balance because your Tarjeta Roma “Más que un Monedero” was damaged, lost, or stolen, we recommend requesting a new card at any branch and then calling the Customer Service Line at 800 025 ROMA with the card in hand, where we will gladly assist you with the transfer. To carry out the transfer, it is very important that the cardholder makes the call, as account authentication details will be requested, and the new card will be registered under the same name and details as the replaced card.
Balance transfers will only be accepted between cards that have a 100% match in personal data on both cards.
GENERAL PROGRAM RESTRICTIONS
- It is a program exclusively for adults.
- Only valid on participating products.
- Not applicable for wholesale sales.
- Institutional clients on credit or cash purchases do not participate.
If you have a pending home delivery service, you will not be able to use your balance during that period. - Your balance does not expire and you can use it whenever you decide; the only requirement is to not stop using your Tarjeta Roma “Más que un Monedero” for more than six months.

COMERCIO ELECTRÓNICO
- Todos los pagos deberán ser en línea, utilizando tarjetas de crédito o débito, las tarjetas autorizadas son VISA, MASTER CARD, AMERICAN EXPRESS.
- Los mínimos de compra en línea son $100.00.
- No se enviarán los pedidos hasta que no se concluya el pago.
- Los productos serán entregados a través de nuestro Servicio a Domicilio y por Pick Up.
- No hay venta de productos controlados a través de la APP ROMA o página WEB, solamente se venden en mostrador.
- Los tiempos de entrega para la compra a través de la APP o página WEB son de un promedio de 60 minutos a 72 horas dependiendo de la disponibilidad del producto.
- En caso de que las condiciones del clima no favorezcan la movilidad de los agentes de reparto el tiempo de entrega puede variar, informando al cliente oportunamente.
- Cualquier cambio o devolución de mercancía podrá efectuarse bajo las siguientes condiciones:
- La devolución deberá realizarse en cualquiera de las sucursales ROMA, presentando ticket de compra.
- Dentro de un plazo no mayor a 24 horas después de realizar la compra.
- En caso de medicamento, el producto deberá tener las etiquetas de Farmacias Roma y sin daños en su empaque, a excepción de que exista inconformidad con la calidad del producto.
- En caso de medicamentos Antibióticos, la receta no podrá ser devuelta al cliente, ya que éstas forman parte de documentos de control interno.
- En caso de devoluciones, el importe se reembolsará en efectivo, el cliente deberá firmar el comprobante de la devolución.
- No se aceptarán pago de servicios en línea.
- Se otorgarán promociones y ofertas exclusivas para APP ROMA y Página WEB que no aplicarán en la venta en sucursal o inclusive ofertas que sean para sucursal que no aplican en APP ROMA y WEB.
- Las entregas del pedido realizado a través de la APP ROMA y página WEB se harán a través del servicio a domicilio y cumpliendo las políticas establecidas en el PL-OPE-001 Políticas de Venta.
- Se podrá expedir factura hasta un mes después de la compra (Siempre y cuando sea en el mismo año fiscal) y que sea del mismo periodo fiscal.
- Para expedir factura se requiere proporcionar el RFC, domicilio fiscal, código postal y correo electrónico.
- No hay monto mínimo para facturar.
- Los datos de facturación deberán registrarse en la APP y página WEB y serán procesados por el personal de la sucursal que enviará la factura por correo electrónico al cliente.
